Atypikoo is a space where its Members can meet and interact, including by organising and taking part in online or in-person events.

This Charter governs events offered on Atypikoo, whether organised by Atypikoo, Members or listed professionals.

It forms an integral part of the Terms of Use within the meaning of Articles 1119 and 1171 of the French Civil Code and Article 14 of Regulation (EU) 2022/2065 (the "DSA"). It supplements the Terms of Use, the Moderation Charter, the Forum Charter, the Trust Charter, the Privacy Policy and, where applicable, the Terms of Sale and Professional Terms of Sale. In the event of any discrepancy, the Terms of Use prevail.

It is applied diligently, objectively and proportionately in accordance with Article 14 DSA.

1. Types of Event concerned

This Charter applies in particular to:

  • Events organised by Atypikoo: meet-ups, workshops, conferences, live sessions, etc. Only Events bearing the "Official Atypikoo" identifier applied by the moderation team fall within this category.
  • Events offered by Members: informal outings, coffee meet-ups, walks, games evenings, etc.
  • Events led by professionals: workshops, discussion groups, bodywork practices, courses, etc., listed or shared through Atypikoo.

Depending on your plan, certain Events may be organised in private mode: they are then visible only to invited people (for example, favourites) and do not appear in the public Event search engine. Where available, this option is reserved for Premium Members and remains subject to this Charter.

Certain rules may vary depending on the type of Event, but the foundation of safety, respect and transparency remains the same.

2. Accessibility and accommodations for atypical needs

To encourage participation by the community's diverse Members, the following are recommended in particular:

  • providing useful preparation information in advance (duration, expected sound and lighting environment, anticipated attendance and the availability of a quiet space);
  • allowing last-minute registration or withdrawal without requiring reasons;
  • accommodating the need for written communication, breaks or a delayed arrival without making it an issue;
  • not requiring a minimum level of oral, social or emotional participation.

Varying scope depending on the type of Event. For Events offered informally by Members, these points constitute good-practice recommendations. For Events organised by Atypikoo ("Official Atypikoo") or by listed professionals, they may constitute more substantial commitments depending on the framework announced in the Event listing.

Reasonable accommodation. The Organiser is invited to consider in good faith reasonable requests relating to accessibility or sensory comfort, without requiring medical evidence or disclosure of a diagnosis, subject to the Event's objective constraints (safety, feasibility and manifestly disproportionate cost). A refusal based on a discriminatory ground within the meaning of Article 225-1 of the French Criminal Code remains prohibited.

3. Responsibilities of an Event Organiser

A Member or professional who offers an Event on Atypikoo undertakes to:

3.1 Respect and inclusion

Offer an Event in a spirit of courtesy, listening and respect, taking into account the specific needs of atypical people or people with disabilities (see Article 2).

3.2 Non-commercial objectives for Members

Events offered by Members in a personal capacity must not have as their main purpose:

  • commercial or non-profit marketing;
  • established partisan promotion (within the meaning of Article 4.3 of the Moderation Charter);
  • recruitment for closed groups or arrangements displaying indicators of sectarian abuse under MIVILUDES criteria.

Events with a professional purpose (coaching, therapy, workshops, etc.) must be clearly identified as such and are subject to the specific framework described in the Professional Terms of Sale and the relevant Event listings.

3.3 Confidentiality

Communicate on the Event page without publishing personal contact details (telephone number, exact home address, private email, etc.) that could be reused outside the Event framework without your consent.

3.4 Clear information

  • State a precise venue (bar, restaurant, park, museum, online platform, etc.) with the information needed to get there.
  • Inform registered Members of any important change (venue, time or format) within a reasonable period.
  • Give sufficient advance notice in the event of cancellation.

3.5 Punctuality and visibility

  • Arrive on time or notify participants in the event of a delay.
  • Be recognisable at the meeting point: if the profile photo does not allow clear identification, provide simple details (clothing, accessory or precise meeting point).

3.6 Availability

Remain contactable on the Event page or through Atypikoo messaging before and during the Event to answer participants' questions (delay, difficulty finding the venue, etc.).

3.7 Clarity about the proposed framework

State honestly whether the Event is:

  • a social outing between Members;
  • a professionally led workshop or group;
  • or a mixed format (social element plus facilitated content).

Do not suggest that a simple social gathering is therapy or present a workshop as curing a condition or guaranteeing impossible results. Any therapeutic, diagnostic or healthcare service is strictly prohibited at Events held by non-professional Members; a breach may result in the application of Article L.4161-1 of the French Public Health Code (unlawful practice of medicine). Healthcare professionals organising an Event declare it under Article 1 and comply with the Code of Ethics applying to their profession.

4. Participants' responsibilities

4.1 Conduct, compliance with instructions and reporting

The Participant behaves courteously towards other participants and the Organiser and complies with reasonable Event-related instructions (venue, times and practical rules). In the event of inappropriate behaviour, discomfort, discriminatory statements or a perceived attempt at coercive control during the Event, the Participant undertakes to report the incident to Atypikoo without delay (help02@atypikoo.com). Prompt reporting allows Atypikoo to review the situation and, where applicable, take appropriate measures.

4.2 Withdrawal

The Participant deregisters if they cannot attend the Event, without having to give reasons.

4.3 Capacity to participate

Each Participant remains responsible for their conduct and assessment of their ability to take part in the Event. For physical or emotionally demanding activities, they are responsible for taking account of their health and, in case of doubt, seeking professional advice.

4.4 Practical framework: accompanying minors, animals and recording

  • Minors: Events are reserved for registered adults. Accompanying children may be present only where expressly authorised by the Organiser; in this case, the accompanying Participant has sole responsibility for the child's supervision and civil liability (Article 1242, paragraph 4, of the French Civil Code).
  • Animals: their presence is subject to the Organiser's agreement, except for assistance dogs (Article L.241-3 of the French Social Action and Families Code). The owner remains responsible for their animal (Article 1243 of the French Civil Code).
  • Recording and dissemination: no recording, photograph, video, live transmission or dissemination of an Event or another Participant is permitted without the express prior consent of the Organiser and Participants concerned (Article 9 of the French Civil Code and Article 226-1 of the French Criminal Code).

4.5 Medical incidents

In the event of a medical incident, the Organiser or Participants present are responsible for alerting the emergency services without delay (15, 18 or 112 in France). Atypikoo does not coordinate emergency assistance or cover its costs.

5. Safety, legality and liability

5.1 Civil liability

All Members taking part in an Event remain responsible for their actions and must, where applicable, be covered by their own civil-liability insurance for risks connected with their participation.

5.2 Safety and legality

Organisers and participants undertake to comply with:

  • basic safety rules (venue capacity, careful conduct and local instructions);
  • applicable laws and regulations (public-order offences, substance use, etc.).

5.3 Participation prohibited for banned accounts

A Member whose account has been banned is not permitted to attend Atypikoo Events, even if they registered before the decision. The consequences of a ban (14-day grace period, selective data purge and anti-reoffending blocklist) are specified in Article 12.3 of the Terms of Use and section 12.6 of the Privacy Policy. In the event of established circumvention (creation of multiple accounts under another identity), Atypikoo may inform the Organiser of known risks, within GDPR limits and after balancing them against the rights of the Member concerned. However, Atypikoo does not guarantee systematic detection of circumvention.

5.4 Atypikoo's legal status according to Event type

  • For "Official Atypikoo" Events (see Article 1), Atypikoo acts as the direct Organiser and assumes the corresponding civil liability within the limits of ordinary law.
  • For Events offered by Members or professionals, Atypikoo acts primarily as an introduction platform and content-hosting provider within the meaning of Article 6-I-2 of the French Law for Confidence in the Digital Economy (LCEN), unless it expressly assumes a more active role: in this capacity, the Platform has no general monitoring obligation (Article 6-I-7 LCEN and Article 8 DSA) and incurs liability only if it fails to act promptly after being notified of manifestly illegal content.

5.5 Prior validation of an Event — limited scope

Prior validation of an Event by Atypikoo (see Article 6.2 below) is a limited formal check: consistency with this Charter, completeness of the listing and absence of a manifest breach. This validation under no circumstances constitutes:

  • an endorsement, approval or recommendation of the Organiser or Event;
  • verification of the qualifications, diplomas, administrative authorisations or professional-register entries declared by the Organiser;
  • verification of the Organiser's character, competence or solvency;
  • an assessment of the venue's physical safety or the Event's actual conduct.

No relationship of authority, subordination, agency or association exists between Atypikoo and the Organiser, who remains an independent third party; the Participant expressly acknowledges this when registering for an Event.

5.6 Corrective measures

In the event of an established breach of the rules, Atypikoo may take the measures provided for in Article 7 (removal of an Event, account suspension or delisting). Responsibility for what occurs during a Member or Professional Event lies primarily with the Organiser and participants.

6. Prevention of coercive control and sectarian abuse

Atypikoo pays particular attention to practices that may constitute sectarian or pseudo-therapeutic abuse. This concerns Events or facilitators displaying several indicators of sectarian abuse published by MIVILUDES (official list at miviludes.gouv.fr), including established mental destabilisation, exorbitant financial demands, induced separation from the person's usual environment, harm to physical integrity, claims of a cure or replacement of medical care.

Where such indicators are present:

  • certain formats or facilitators may be refused, restricted or delisted under the conditions of Article 7;
  • Events may be subject to enhanced analysis in the event of doubts or repeated negative feedback;
  • in the event of manifest danger or serious suspicion, certain information may be sent to MIVILUDES or the competent authorities under the conditions of Article 11 of the Moderation Charter (notification of the Member concerned within a reasonable period, unless prohibited by law).

7. Measures applying to an Event or Organiser

7.1 Graduated measures

In the event of a breach of this Charter, the Terms of Use or the Moderation Charter, Atypikoo may:

  • request a change to the Event listing (description, venue or times);
  • add public context (information notice in the listing);
  • temporarily hide the Event pending review;
  • remove the Event from the Platform;
  • delist an Organiser or professional for future Events;
  • suspend or ban the Organiser's account under the conditions of the Terms of Use and Moderation Charter.

7.2 Grounds for these measures

These measures may be based in particular on:

  • breach of the commitments in Article 3 (misleading information, absence of a clear framework or commercial opacity);
  • discriminatory refusal of reasonable accommodation within the meaning of Article 2;
  • conduct by the Organiser or participants covered by Article 4 of the Moderation Charter;
  • presence of MIVILUDES indicators establishing sectarian or pseudo-therapeutic abuse (Article 6);
  • multiple reports or detailed feedback calling into question the Event's safety, ethics or legality;
  • overbooking or failure to comply with stated capacity, which may constitute a misleading commercial practice (Article L.121-2 of the French Consumer Code);
  • late cancellation or repeated no-show by the Organiser without notice or refund;
  • capturing, recording or disseminating images, sound or video of participants without their prior informed consent (Article 9 of the French Civil Code and Article 6 GDPR);
  • diversion from the Event's stated purpose (for example, changing a social gathering into an undeclared commercial, partisan or proselytising operation);
  • circumvention by the Organiser of an earlier measure (for example, republishing a previously removed Event under a different listing).

7.3 Reasoned notification and right of appeal

Every adverse measure (required modification, hiding, removal or delisting) is subject to a reasoned notification to the Organiser in accordance with Article 17 DSA, specifying:

  • the type of measure and its temporal scope;
  • the facts and rules relied upon;
  • the appeal options set out below.

The Organiser has the following appeal options:

  • Contact channel with Atypikoo: by email to help02@atypikoo.com. Atypikoo reviews the information provided and may confirm, amend or reverse its decision, without committing to a timeframe;
  • Consumer mediation for disputes relating to paid offers collected by Atypikoo (see Article 8.1). The competent mediator is CM2C, 49 rue de Ponthieu, 75008 Paris, France (referral at www.cm2c.net, telephone +33 (0)1 89 47 00 14).
  • Court proceedings before the competent courts.

8. Registrations, payments and cancellations

8.1 Where Atypikoo manages payments

For certain Events (including those organised by Atypikoo), payment may be collected by Atypikoo through the secure Stripe platform. Atypikoo stores no bank details. Registration, cancellation and refund terms are then specified in the Event listing and in the applicable Terms of Sale or Professional Terms of Sale.

8.2 Where the Organiser manages payments

For paid Events where payment is made directly to the Organiser (Member or Professional), the contract is entered into exclusively between the Participant and the Organiser. Atypikoo collects no amount, receives no commission, is not a party to the contract and does not guarantee performance. In accordance with Article L.221-1-1 of the French Consumer Code, the Organiser's identity and capacity (Consumer or Professional) are displayed in the Event listing. In the event of a financial dispute, the Participant must contact the Organiser directly. Atypikoo may change the visibility of the Event or Organiser account under the conditions of Article 7.

8.3 Consumer Participant's remedies — applicable mediation scheme

In the event of a dispute concerning a paid Event and no amicable resolution, the applicable consumer-mediation scheme depends on the capacity of the party collecting payment:

  • Atypikoo collects payment (Article 8.1): the consumer mediator appointed in Atypikoo's Terms of Sale has jurisdiction;
  • Professional Organiser collects payment directly (Article 8.2): as the contract exclusively binds the Participant and the Organiser, the Consumer Participant refers the matter to the Organiser's own consumer mediator (the Professional is required to appoint one — Article L.616-1 of the French Consumer Code);
  • Non-professional Member Organiser: consumer-mediation schemes do not apply (relationship between two private individuals). Amicable resolution takes place directly between the parties; Atypikoo may intervene only in relation to the visibility of the Event or account (Article 7).

9. Reports and use of AI

9.1 Event-related reports

You may report an Event, behaviour or an Organiser if it appears problematic (harassment, discriminatory statements, discomfort, indicators of sectarian abuse, dangerous physical conditions, etc.).

9.2 Use of AI

Certain reports or Event-related content may be analysed by artificial-intelligence tools in order to identify signs of abuse, hate speech or particular risks and help the moderation team prioritise cases.

These tools support decisions but never make them: no penalty is imposed exclusively through automated processing (Article 22 GDPR). Final decisions are made by human beings in accordance with the Moderation Charter, the Terms of Use and the Privacy Policy.

10. Personal data and confidentiality

In connection with Events, Atypikoo may process:

  • your identification data (profile and email);
  • your registrations and attendance;
  • your feedback, reviews and reports;
  • information in Event listings and associated exchanges.

The legal basis for this processing (consent, legitimate interest and performance of the contract), retention periods and associated rights are described in the Privacy Policy. In particular, you have rights of access, rectification, erasure, objection and portability, and the right to lodge a complaint with the CNIL.

Official Atypikoo Event. Atypikoo is the sole controller of the attendee list and of the data necessary to organise the Event.

Event organised by a non-professional Member. Atypikoo is the controller for registration completed on the Platform. The Organiser is only a recipient of the data strictly necessary for practical organisation, with no right to reuse it, carry out marketing, add it to a mailing list or disclose it to a third party without their own legal basis and prior information.

Event organised by a Professional Member. For registrations managed on the Platform, Atypikoo and the Professional Member are joint controllers under Article 12.1 of the Professional Terms of Sale, which contains the arrangement required by Article 26 GDPR and the essence of its allocation.

External collection or the Organiser's own purpose. The Organiser is the sole controller of data collected outside the Platform or reused for the Organiser's own purpose, including marketing. In every case, access to the attendee list is limited to organisational needs and is subject to confidentiality and security obligations. Any unauthorised use is a breach subject to measures under Article 7, without prejudice to the penalties provided by the GDPR.

11. Updates to the Event Charter

  • This Charter may be updated if the Event format develops, the legal framework changes or community feedback shows that an adjustment is necessary.
  • In the event of a material change, where possible Atypikoo informs Members by an appropriate means (notification, email or banner on the Website) before it takes effect. Changes required by law, relating to Platform security or the fight against abuse, or consisting only of clarification with no adverse effect, may take effect immediately.
  • No retroactive effect. Events and conduct are assessed under the Charter in force on the date of the facts. Procedural safeguards (appeal and reasons) apply under the Charter in force on the date the appeal is brought, unless a provision is more favourable to the Member.
