Article 1 – PREAMBLE AND ACCEPTANCE OF THE TERMS OF USE

The website available at https://www.atypikoo.com and the associated mobile application (together referred to below as "Atypikoo" or the "Platform") are published by ATYPIKOO SAS, a French simplified joint-stock company with share capital of €100,000, registered with the Limoges Trade and Companies Register under number 905 199 824, whose registered office is at 1 avenue d’Ester, ESTER Technopole, 87280 Limoges, France (the "Publisher" or "Atypikoo").

Atypikoo is a platform for meeting people, interacting and attending events, intended for people who identify with atypical profiles (neurodivergence, high sensitivity, giftedness, etc.). Its aim is to provide a safer, supportive environment adapted to these communities.

These Terms of Use are intended to define the rules for accessing and using the Platform.

By creating an account or using the Platform, you acknowledge that you have read and unreservedly accept the Terms of Use.

The use of certain paid services is also governed by the Terms of Sale and, where applicable, the Professional Terms of Sale. The processing of your personal data is described in the Privacy Policy and the use of trackers in the Cookie Policy.

In the event of any contradiction, the Terms of Use prevail over information notices and ancillary charters.


Article 2 – DEFINITIONS

For the purposes of these Terms of Use, the following terms have the meanings set out below:

  • "Website": the website https://www.atypikoo.com and its subdomains.
  • "Application" or "App": the Atypikoo mobile application available from app stores.
  • "Platform": the Website, App and associated digital services as a whole.
  • "Member": any person with an active personal account on Atypikoo.
  • "Premium Member": a Member who has purchased a paid plan in accordance with the Terms of Sale.
  • "Visitor": a person accessing the Website without an account or without being logged in.
  • "Services": all features offered by Atypikoo (dating, forums, private messaging, events, tests, professional directory, support, etc.).
  • "Virtual Love coach": an account managed by an artificial-intelligence system that provides conversational guidance on relationships and dating.
  • "Team Atypikoo Support": user support which may be provided in part by a virtual agent relying on AI services supplied by Google (Gemini) and/or Mistral AI.
  • "Content": any information, text, photograph, video, message or other material published, sent or shared by a Member or Visitor on the Platform.
  • "Report": an action by which a Member or Visitor reports to Atypikoo content or behaviour they consider problematic.

Article 3 – REGISTRATION, ACCOUNT AND SECURITY

3.1 Registration requirements

Registration with Atypikoo is strictly reserved for adults (aged 18 or over) who have legal capacity under the law of their country of residence. Date of birth is required for registration and is checked automatically: any registration by a minor is rejected. Atypikoo applies a zero-tolerance policy to the presence of minors on the Platform, as detailed in its Policy on the protection of minors.

When creating an account, you must provide accurate, up-to-date and complete information. Certain information is required to access the Services (and identified as such in the forms).

Atypikoo reserves the right to refuse or suspend a registration in the event of a manifest breach of the Platform rules or where profiles are manifestly unrelated to the community's central theme (meeting and interacting around atypical traits, neurodiversity, etc.).

3.2 Account creation and validation

The account is created using a valid email address associated with a password. Atypikoo may also offer login using a unique validation link sent by email ("magic link"). A validation procedure (confirmation email and additional checks) may be implemented to secure accounts and limit fake profiles.

The Member undertakes to:

  • provide truthful, honest and up-to-date information;
  • not create fake profiles or impersonate another person;
  • not create multiple accounts for the same person.

3.3 Login details and security

You are solely responsible for keeping your login details (email address, password, etc.) confidential and for the use of your account. If you suspect unauthorised access, you must change your password and inform Atypikoo as soon as possible.

Atypikoo may impose enhanced security measures (complex password, additional authentication, email verification, etc.).

3.4 Confidentiality of public information in profiles and visible areas

The Member undertakes not to publish, in public or widely visible parts of the Platform (profile, forums, events, comments, event descriptions, etc.), data enabling them to be directly identified, such as:

  • surname;
  • postal address;
  • personal email address;
  • telephone number;
  • complete identifiers for other social networks;
  • any sensitive information enabling identification or direct contact outside the Platform without the Member's control.

Where applicable, this information may be communicated in private messages under the Member's sole responsibility and at their own risk.


Article 4 – DESCRIPTION OF THE SERVICES

4.1 Main Services

The Platform offers in particular:

  • a dating and introduction area (profiles, filters, favourites, matches, messaging, etc.);
  • a forum and themed discussion areas;
  • a private messaging system between Members;
  • a directory of listed professionals;
  • online and in-person events;
  • self-assessment tests;
  • magazine-style informational content;
  • guidance services, including a virtual Love coach.

Some services are available free of charge, while others are reserved for Premium Members or professionals in accordance with the Terms of Sale and Professional Terms of Sale.

4.2 Paid Services

The prices, payment terms, commitment periods and cancellation arrangements for paid plans (subscription, premium access, professional services, etc.) are detailed in the Terms of Sale and Professional Terms of Sale, which supplement these Terms of Use.

Payments made from the website are managed by the Stripe platform. In-app purchases made from the mobile application are managed by the Apple App Store and Google Play platforms, whose receipts are processed through Adapty. Atypikoo does not collect or store full bank card numbers.

4.3 Tests, content and guidance

Tests, questionnaires, profile results and guidance content (including through the virtual Love coach) are provided for information and guidance purposes.

They do not constitute a medical or psychological diagnosis, therapeutic care, or legal or financial advice. They are not a substitute for consulting a healthcare professional or any other qualified professional.

In the event of psychological distress, suicidal thoughts, danger or an emergency, you should contact emergency services or specialist helplines. Atypikoo is not an emergency service.


Article 5 – FORUMS, TOPIC VISIBILITY AND MESSAGING

5.1 Forums and public visibility of topics

Atypikoo forums allow Members to open and reply to discussion topics.

By default:

  • the title and content of a forum topic's initial message may be made publicly readable and indexed by search engines;
  • replies to that topic remain accessible only to logged-in Members.

To protect Members' privacy:

  • topics made public are not associated with your first name or profile photo;
  • only your pseudonym and, where applicable, a non-photographic avatar may appear publicly;
  • Atypikoo recommends that you do not include information that directly identifies you (full name, contact details, exact address, etc.) in the title or body of a topic when it is not created as a private topic.

When creating a topic, Premium Members may select the "private topic" option. In this case:

  • the topic is not indexed by search engines;
  • the topic may be viewed only by logged-in Members.

The detailed rules governing forum use appear in the Forum Charter, which forms an integral part of Atypikoo's legal framework.

5.2 Prior moderation of forum topics

Before being posted online, new forum topics may be subject to:

  • automated checking by an AI system (see Article 6);
  • and/or verification by the moderation team.

This analysis is intended to verify that topics comply with the Forum Charter and these Terms of Use, particularly with regard to hateful, discriminatory or defamatory statements, suspicious solicitations or manifestly illegal content.

Depending on the results:

  • the topic may be published;
  • held for human review;
  • any refusal decision being made by a member of the moderation team.

5.3 Private messaging and other exchanges

Members may communicate through private messaging and, where applicable, other channels (comments, groups, etc.).

Private messaging is not intended for illegal exchanges, harassment, unauthorised marketing or abusive solicitations.

Content from private messaging may be reviewed by Atypikoo:

  • where it is reported by a Member;
  • where Atypikoo is made aware of a serious risk to the safety of individuals or the Platform;
  • or in the cases provided for by law and these Terms of Use.

Atypikoo does not systematically read private messages.


Article 6 – AI-ASSISTED SERVICES AND PERSONAL DATA

This section explains in simplified terms how Atypikoo uses artificial-intelligence (AI) systems in connection with certain Services. Full details of how your data is processed appear in the Privacy Policy.

6.1 General principle

Atypikoo uses AI services to:

  • answer user questions through "Team Atypikoo" support;
  • provide relationship guidance through the virtual Love coach;
  • assist moderation and the processing of reports (forums, profiles, messages, etc.);
  • analyse certain new forum topics before publication.

These services involve sending text content (your questions, messages and reports) to AI systems operated by third-party service providers, including Google (Gemini service) and Mistral AI (a European company based in France).

Atypikoo endeavours to limit directly identifying data in the information sent to these services and does not send them your login details or bank details.

Atypikoo does not use Members' content to train its service providers' artificial-intelligence models: this content is sent solely to generate a response or perform the requested analysis, then processed in accordance with the Privacy Policy.

6.2 "Team Atypikoo" support

When you contact support through the "Team Atypikoo" assistant, all or part of your message may be sent to an AI service (Google Gemini or Mistral AI) to generate a response.

The purposes of this processing are:

  • to respond to your requests for help or information;
  • to follow up requests and maintain support quality.

Messages may be retained for a limited period for follow-up, service improvement and evidential purposes in the event of a dispute, in accordance with the periods specified in the Privacy Policy.

6.3 Virtual Love coach

The "Love coach" account is a virtual assistant that uses AI (Google Gemini and/or Mistral AI) to suggest avenues for reflection about your relationships, dating and emotional life.

The messages you exchange with this account:

  • are processed by an AI system to generate responses;
  • may be retained for a limited period to ensure the proper operation of the service and, where applicable, for evidential purposes, in accordance with the Privacy Policy; they are not used to train AI models.

By using the virtual Love coach, you acknowledge that the content of your exchanges is processed by AI systems.

The responses provided:

  • do not constitute a medical or psychological diagnosis;
  • do not replace therapy, medical monitoring or professional support;
  • do not constitute legal or financial advice.

6.4 AI-assisted moderation and reports

When you report a profile, private message, forum post, comment or any other content:

  • the reported content may be automatically analysed by AI tools;
  • this analysis is intended to identify indicators of a breach of Atypikoo's rules (harassment, discriminatory statements, fraud, inappropriate sexual content, dangerous incitement, etc.);
  • the results are used to prioritise and guide the moderation team's work.

By submitting a report, you are informed that the associated content may be automatically analysed for security and moderation purposes under the conditions described in the Privacy Policy.

Moderation decisions (warnings, restrictions, suspensions and bans) are always made by human beings.

6.5 Automatic analysis of new forum topics

Before publication, forum topics may be analysed by AI systems to verify their compliance with Atypikoo's rules (including the Forum Charter).

This analysis may result in:

  • immediate publication;
  • the topic being held for review by the moderation team.

Any refusal to publish is decided by a member of the moderation team in accordance with Article 6.4.

6.6 Your rights

For the processing described in this Article, you have the rights provided for by personal-data legislation (access, rectification, erasure, restriction and, in certain cases, objection).

The procedure for exercising these rights and the legal bases for such processing are detailed in the Privacy Policy. Exercising certain rights may restrict or prevent access to certain Services (for example, AI support or the virtual Love coach).


Article 7 – RULES OF CONDUCT AND PROHIBITED CONTENT

7.1 General principles

Atypikoo is designed as a respectful space for meeting and interacting with others. By using the Platform, you undertake to:

  • respect other Members, the Atypikoo team and listed professionals;
  • communicate clearly, honestly and without manipulation;
  • not exploit the vulnerability or fragility of other Members.

7.2 Prohibited content and behaviour

The following are prohibited in particular:

  • hateful, discriminatory, racist, sexist, LGBT-phobic, fatphobic or stigmatising statements;
  • harassment, threats, intimidation, or incitement to suicide or self-harm;
  • dissemination of violent, pornographic or inappropriate content, particularly when directed at vulnerable people;
  • fraud, scams, pyramid schemes or abusive financial solicitations;
  • promotion of sectarian practices, manipulative movements or high-risk groups;
  • identity theft and the creation of fake or misleading profiles;
  • unauthorised collection of other Members' data;
  • sending spam, unauthorised marketing or disguised advertising;
  • disseminating content that infringes copyright or third-party rights.

Detailed rules and examples of behaviour that will not be tolerated are set out in the Moderation Charter and Trust Charter.

7.3 Professional promotion, advertising and recruitment

Outside the areas explicitly provided for this purpose (professional directory, professional events, sections dedicated to professional activity, etc.), the Member undertakes not to:

  • use Atypikoo to promote products, services or professional activities;
  • publish commercial or advertising messages on profiles, forums, public events or other community areas;
  • recruit on behalf of a company, recruitment agency or third party;
  • organise paid referral schemes or use affiliate links that generate personal remuneration, particularly in profiles, forums, events or public messages.

Professional events must comply with the Professional Terms of Sale and the Event Charter.


Article 8 – MODERATION, REPORTS AND PENALTIES

8.1 Organisation of moderation

Moderation on Atypikoo combines:

  • a dedicated in-house human moderation team;
  • technical tools, including AI systems, to detect certain content and prioritise actions.

The Moderation Charter details the team's principles, priorities and decision-making criteria.

8.2 Reports

Any Member may report to Atypikoo a profile, message, forum content, event or any other material they consider problematic.

Any report may result in:

  • automated analysis by AI tools (see Article 6.4);
  • human review by the moderation team;
  • where applicable, requests for explanations addressed to the Members concerned.

8.3 Penalties

In the event of failure to comply with the Terms of Use, the applicable charters or the law, Atypikoo may take the following measures separately or in combination:

  • reminder or warning;
  • removal or modification of content;
  • temporary restriction of certain features;
  • temporary suspension of the account;
  • permanent deletion of the account;
  • prohibition on registering again;
  • exclusion from one or more events organised through the Platform;
  • reporting to the competent authorities where required or justified by law.

Where possible and appropriate, Atypikoo seeks to apply a graduated approach. However, immediate suspension or deletion may be decided in certain serious or urgent cases. A permanently banned Member may be denied access to events, including events for which they were already registered.

8.4 Identity verification

Where there is serious doubt about a Member's identity or age, in the presence of serious reports, or where a body of factual evidence suggests an attempt to circumvent a previous ban (matching IP addresses, behavioural patterns or profile similarities, including through login with a third-party account — Google, Apple or Facebook OAuth), Atypikoo may request that an official and valid identity document be sent by secure email to help02@atypikoo.com within a reasonable period, which may be shortened (for example to 24 hours) in an emergency (see Article 5 of the Moderation Charter). The document sent is used solely for this check and is not retained beyond the period strictly necessary.

If no response is received within the stated period, or if the information is inconsistent or fraudulent, Atypikoo may suspend the account as a precaution and, where applicable, impose a permanent ban.


Article 9 – SECURITY, PREVENTION AND SECTARIAN ABUSE

Atypikoo implements tools and procedures intended to:

  • limit manipulative behaviour, coercive control or abuse of vulnerability;
  • identify signs of sectarian abuse or suspicious practices;
  • encourage Members to remain vigilant.

These arrangements are based on:

  • human moderation;
  • analysis of reports;
  • technical tools, some of which rely on AI.

Atypikoo has no general monitoring obligation, but endeavours to deal seriously with reports, particularly where risks of coercive control, sectarian abuse or endangerment are raised. In an emergency or in the event of danger, however, Members are responsible for contacting the appropriate services (emergency services, police, helplines, etc.).


Article 10 – INTELLECTUAL PROPERTY AND HYPERLINKS

10.1 Atypikoo content

The Platform's general structure and all content published by Atypikoo (texts, logos, graphics, videos, modules, etc.) are protected by intellectual-property law.

Without prior written authorisation, you may not:

  • reproduce, display, disseminate, adapt or exploit this content;
  • extract or reuse a substantial part of Atypikoo's databases.

10.2 Content published by Members

You retain the rights to the content you publish (texts, photographs, etc.). By publishing content on the Platform, you grant Atypikoo a non-exclusive, worldwide, royalty-free licence to:

  • reproduce, display, adapt, translate, store and disseminate it in connection with the operation and development of the Platform (including public forums, the application and Atypikoo communication materials).

You warrant that you have the necessary rights to publish this content and that it does not infringe third-party rights.

10.3 Hyperlinks published on the Platform

Hyperlinks published by Members (forums, profiles, events, comments and public messages) must be intended to share useful information consistent with Atypikoo's purpose. The following are prohibited:

  • links to illegal, hateful or violent content, or content contrary to the Terms of Use;
  • links intended as disguised promotion or mainly to advertise a product or service outside the designated areas;
  • affiliate links or links generating remuneration for the Member (affiliate programmes, paid referrals, etc.) in community areas.

Atypikoo does not systematically exercise editorial control over the third-party websites to which these links point and cannot be held liable for their content. It may remove any link it considers contrary to the Terms of Use.

10.4 Links to Atypikoo from other websites

Creating a link to the Atypikoo Platform is permitted provided that it does not harm its image or interests (disparagement, misleading use, unauthorised commercial exploitation, etc.). Atypikoo may request the removal at any time of any link it considers abusive or harmful.


Article 11 – PERSONAL DATA

The processing of your personal data in connection with Atypikoo is described in detail in the Privacy Policy available on the Website.

That policy specifies in particular:

  • the data collected;
  • the purposes of processing, including those relating to AI-assisted services, forums and moderation;
  • the legal bases;
  • retention periods;
  • recipients and any transfers outside the EU;
  • your rights (access, rectification, erasure, restriction, objection and portability) and how to exercise them.

These Terms of Use refer to that policy, which forms an integral part of the contractual framework governing use of the Platform.


Article 12 – ACCOUNT BLOCKING, SUSPENSION AND DELETION

12.1 Blocking, suspension and banning at Atypikoo's initiative

12.1.1 Grounds and nature of the penalty

Atypikoo may restrict, suspend or ban an account in the event of:

  • failure to comply with the Terms of Use, the charters or the law;
  • serious or repeated reports;
  • suspected fraudulent use, hacking or compromise of the account.

The penalty is proportionate to the established facts. Where possible and appropriate, Atypikoo seeks to apply a graduated approach (warning, suspension, then a ban in the event of repeat offending). Behaviour that may justify an immediate ban without prior warning is listed in the Moderation Charter; an immediate ban also remains possible where there is a serious and manifest risk to Members' safety, the integrity of the Platform or compliance with a legal obligation. Unconfirmed suspicion may justify only a precautionary suspension, which is lifted or converted into a ban after investigation.

12.1.2 Reasoned notice and right of appeal

In accordance with Article 17 of Regulation (EU) 2022/2065, known as the "DSA", and the Moderation Charter, every account-restriction decision is subject to a reasoned notice sent to the email address associated with the account. This notice specifies:

  • the type of decision (suspension or temporary or permanent ban), together with its territorial scope and duration where applicable;
  • the facts and circumstances that led to the decision;
  • the rules relied upon (Terms of Use, Charters or legal provisions);
  • whether or not the decision was automated: Atypikoo confirms that every banning decision is made by a human administrator, including where it relies on automated analysis tools (see Article 6);
  • the appeal options listed below.

The Member may send to help02@atypikoo.com any information they consider relevant to their case (context, factual information and observations). Atypikoo reviews the information provided and may confirm, amend or reverse its decision, without committing to a timeframe. The Member also retains the benefit of remedies available under ordinary law (see Article 15).

12.1.3 Immediate effect on sessions

A ban results in the immediate invalidation of all the Member's active sessions and the removal from public display of notifications issued by that Member. Technical retention of account data is governed by Article 12.3.

12.2 Account deletion by the Member

You may delete your account at any time from your personal area using the dedicated page ("Settings"/"Account"). Deletion takes effect after a 24-hour period during which the operation can be cancelled by logging in again before the period expires. After this period, deletion becomes irreversible. Atypikoo support will intervene only in the event of a technical problem that objectively prevents the account from being deleted in this way.

Deleting the account results in loss of access to the Services, including those purchased as part of a paid plan, subject to the specific provisions of the Terms of Sale and Professional Terms of Sale.

If there has been no login for an extended period (3 years), Atypikoo may automatically delete the account under the same arrangements.

Certain data may be retained or pseudonymised after the account is deleted in order to comply with legal obligations, manage disputes, ensure Platform security or serve as evidence. The categories of data actually deleted (photos, extended profile characteristics, notifications, tokens, etc.) and those retained in pseudonymised form (truncated email, forum posts and private messages) are specified in the Privacy Policy.

12.3 Data retention in the event of a ban

Where a Member is banned by Atypikoo, the data associated with the account is processed in accordance with the data-minimisation principle set out in Article 5(1)(c) GDPR and the following timetable.

12.3.1 Fourteen (14)-day grace period

For fourteen days after the ban is imposed, the account data is retained in full. This period allows any internal appeal to be examined and the decision to be fully reversed where a moderation error is established.

12.3.2 Purge after the grace period

At the end of the fourteen-day period, unless the decision has been reversed, profile data is permanently deleted: photographs (profile and gallery, including from external storage), profile description and characteristics, extended characteristics that may fall within the special categories of Article 9 GDPR, favourite and hiding lists, visits, votes, notifications, activity history and personal settings. Processing of data falling within Article 9 is governed by Section 5 of the Privacy Policy and, where applicable, is based on the Member's explicit consent. Purging data following a ban is a deletion measure decided by Atypikoo and does not, in itself, constitute withdrawal of consent expressed by the Member.

Until the purge has been carried out, a reversal decision results in the data being fully restored. Once the purge has been carried out, restoration is technically impossible; however, the Member retains the right to have their account reactivated and to their forum and private messages that have not been purged.

12.3.3 Hiding content belonging to a banned Member

As soon as the ban is imposed, all content published by the banned Member (forum posts, topics, comments and private messages) is automatically hidden from other Members. This security measure is based on the legitimate interest of Atypikoo and its community in protecting themselves against the post-ban exploitation of such content, and on the processing-security obligation (Article 32 GDPR). The content remains stored in an inaccessible form for evidential purposes and to respond to any judicial requests, for the periods specified in the Privacy Policy.

If the ban is reversed (see Article 12.3.6), access to the content is restored at the same time.

12.3.4 Hashes for preventing repeat offending

To prevent a banned Member from creating new accounts, on the basis of Atypikoo's legitimate interest (Article 6(1)(f) GDPR) in protecting community security — following a documented balancing exercise against the rights of the persons concerned, available on request — Atypikoo retains, for the limited periods specified in the Privacy Policy: the account pseudonym (which cannot be reused), a non-reversible cryptographic hash of the email address, and the registration IP address. This information is deleted immediately if the ban is reversed.

12.3.5 Record of the moderation decision

The moderation decision (reason, cited extracts, rules relied upon, date and moderator identity) is retained for a maximum of five (5) years in order to respond to any appeal, a request for access under Article 15 GDPR, or a request from a competent authority.

12.3.6 Exercise of GDPR rights after a ban

The Member retains all their GDPR rights: access (Article 15) to the data still retained and the reasoned decision, portability (Article 20), erasure (Article 17) and objection (Article 21) to processing based on legitimate interest — the latter two being considered on a case-by-case basis, subject in particular to the establishment, exercise or defence of legal claims (Article 17(3)(e) GDPR). Atypikoo confirms that every banning decision is made by a human administrator (Article 22).

These requests should be sent to help02@atypikoo.com, the contact point for data-protection matters. The Member also has the right to lodge a complaint with the French Data Protection Authority (Commission nationale de l’informatique et des libertés — CNIL), under the conditions specified in the Privacy Policy.


Article 13 – LIABILITY

13.1 Atypikoo's liability

Atypikoo is subject to an obligation to use reasonable means and implements reasonable resources to ensure:

  • the proper operation of the Platform;
  • account security;
  • appropriate content moderation.

However, Atypikoo cannot guarantee:

  • the complete absence of bugs, interruptions or malfunctions;
  • the accuracy, completeness or relevance of content published by Members and listed professionals;
  • the success of meetings, relationships, exchanges or collaborations initiated through the Platform;
  • the systematic detection of high-risk behaviour, attempts to circumvent bans, or false age or identity declarations.

13.2 Acts of third parties and events

Subject to mandatory provisions protecting Consumers and cases of established gross negligence or wilful misconduct by Atypikoo:

  • Atypikoo is not a party to contractual relationships that may arise between Members or between a Member and a listed professional. It cannot be held liable for the quality, content, conduct or direct or indirect consequences of the services, exchanges, meetings or transactions entered into in this way.
  • For events organised by Members or professionals through the Platform (see the Event Charter), Atypikoo acts as a hosting provider within the meaning of Article 6-I-2 of the French Law for Confidence in the Digital Economy (LCEN), unless the event is explicitly marked "Official Atypikoo", and cannot be held liable for incidents, physical, material or non-material harm, accidents, theft, assault, harassment or disputes occurring during, before or after such events, including during outbound and return journeys.
  • Prior validation of an event or listing of a professional constitutes a limited formal check (consistency with the Charters and completeness of the listing) and under no circumstances constitutes an endorsement, approval or recommendation of the organiser or professional.
  • Content published by third parties (messages, profiles, event listings and forum contributions) is the sole responsibility of its authors; Atypikoo incurs liability only if it fails to act promptly after being notified of manifestly illegal content (Article 6-I-7 LCEN).

13.3 Conversational assistants (AI — Love coach and assisted support)

Atypikoo provides certain conversational assistants based on artificial-intelligence models (including the "Love coach" and certain support responses). These tools:

  • have neither a real understanding of a situation nor medical, psychological, legal or financial expertise;
  • may produce responses that are inaccurate, incomplete or inappropriate to the Member's personal situation;
  • must never be followed without applying judgment or be used as a substitute for the opinion of a qualified professional.

To the extent permitted by mandatory provisions, Atypikoo excludes all liability for decisions made by the Member on the basis of exchanges with a conversational assistant, including in emotional, family, professional, financial, medical or existential matters. In a situation of distress, the Member is advised to contact a healthcare professional or the support resources indicated on the Platform without delay.

13.4 Members' liability

You are responsible for:

  • the information provided during registration and keeping it up to date, including your declaration that you are of legal age;
  • the content you publish and messages you send;
  • your use of the Platform and the meetings resulting from it;
  • taking reasonable precautions before any in-person meeting, professional collaboration or exchange of sensitive information;
  • reporting as soon as possible, using the designated tools, any high-risk or manipulative behaviour, or any indication that another Member is being endangered, of which you become aware.

13.5 Identity verification and false declarations

Atypikoo may verify a Member's identity or age under the conditions set out in Article 8.4.

Any false declaration concerning age, identity, professional capacity or any information governing access to the Platform may result in the suspension or deletion of the account, without prejudice to any civil or criminal liability incurred by its author. The Member shall indemnify Atypikoo against any third-party claim resulting from such a false declaration.


Article 14 – AMENDMENT OF THE TERMS OF USE AND DEVELOPMENT OF THE SERVICES

Atypikoo may amend these Terms of Use to reflect:

  • changes to its Services;
  • legislative or regulatory changes;
  • improvements to its security and moderation arrangements, including those related to AI.

In the event of a material change, Members will be informed by an appropriate means (notification, email, banner on the Website, etc.). Changes required by law, relating to Platform security or the fight against abuse, or consisting only of clarification with no adverse effect, may take effect immediately. Continued use of the Platform after the new Terms of Use take effect constitutes acceptance of them.

Atypikoo may also change all or part of its Services (addition, modification or removal of features), without being required to maintain a free or paid feature in an identical form, subject to compliance with the Terms of Sale for current paid plans.


Article 15 – LANGUAGES, GOVERNING LAW AND DISPUTE RESOLUTION

15.1 Languages

These Terms of Use are drafted in French and made available in English and Spanish. The translated versions are intended to faithfully reproduce the content of the French version. In the event of any difference in interpretation, the French version shall be the reference version, subject to the interpretation most favourable to the consumer and to the mandatory provisions applicable in the consumer’s country of residence. This clause is neither intended nor shall have the effect of depriving the consumer of any protection that cannot be waived.

15.2 Governing law and dispute resolution

These Terms of Use are governed by French law.

In the event of a dispute, Atypikoo and the Member will endeavour to reach an amicable solution.

The Member undertakes not to bring proceedings against Atypikoo that are manifestly abusive or intended to delay. In the event of abusive proceedings, Atypikoo reserves the right to rely on all legal remedies necessary to defend its interests.

If no amicable agreement is reached, a consumer Member may bring proceedings, at their option, before the court of the place where they resided when the contract was entered into, the court of the place where the harmful event occurred, or any other court with territorial jurisdiction under the rules of the French Code of Civil Procedure. No clause of these Terms of Use may deprive the consumer of the benefit of these protective jurisdiction rules.

The consumer Member is informed that they may use a consumer mediation scheme free of charge; details of how to refer a matter to mediation are specified in the Terms of Sale.
